  • They are armed with a deadly weapon (such as a gun or knife), or a simulation of a deadly weapon (such as a pellet gun) at the time of the robbery
  • They used, or threatened to use, a deadly weapon, simulated deadly weapon, or dangerous instrument in the commission of the crime


The offense is still considered armed robbery even if the gun is never drawn or directed at anyone, or if it is unloaded. Further, even crude simulations of a gun (such as a pointed finger in a pocket) can result in armed robbery charges if the victim is fooled into thinking it is a dangerous weapon.
